MUSEIN AI TERMS OF SERVICE

1. Introduction and Acceptance

Welcome to Musein AI! These Terms of Service (“Terms”) govern your access to and use of the musein.ai website, mobile applications, and AI-powered visual creation, animation, and multi-modal digital art engine (collectively, the “Services”).

The Services are provided and operated by MUSEIN AI PTE. LTD., a company registered in Singapore. In these Terms, MUSEIN AI PTE. LTD. is collectively referred to as “Musein AI,” “we,” “our,” or “us.”

By accessing, registering for, or using our Services, you agree to be bound by these Terms. If you do not agree to all the terms and conditions, you must not use the Services.

2. Eligibility and Age Requirements

The Services are intended for a general adult audience and professional creators. You must be at least 13 years old (or the minimum legal age of digital consent in your jurisdiction, such as 16 in certain EU countries) to use the Services.

If you are under 18, you must have the explicit permission of your parent or legal guardian to use the Services. We do not knowingly collect information from children under 13, and any account found in violation of this rule will be immediately terminated, and associated data will be promptly deleted or anonymized.

3. Intellectual Property and Content Ownership

The intersection of generative AI and intellectual property requires clear boundaries regarding what you own and what we own.

• Platform Ownership: You expressly acknowledge that Musein AI and/or its licensors own all right, title, and interest in and to the Services, including their interface design, text, graphics, AI models, algorithms, software, and proprietary technology.
• Your Inputs: You retain all ownership rights to the text prompts, reference images, audio, and any other materials you upload or input into the Services (“Inputs”). You grant Musein AI a limited license to process these Inputs solely to provide the Services to you and, subject to your explicit consent and our Privacy Policy, to improve our generative models.
• Your Outputs: Subject to your compliance with these Terms, Musein AI assigns to you all of its right, title, and interest in and to the visuals, animations, and content generated by the Services based on your Inputs (“Outputs”).
• Non-Exclusivity of AI Outputs: Due to the nature of machine learning and artificial intelligence, Outputs may not be unique. Other users may input similar prompts and receive identical or highly similar Outputs. Musein AI does not guarantee that you have any exclusive legal ownership of any Output, nor do we guarantee that any Output is protected by intellectual property rights, or that it does not infringe upon any third-party proprietary rights.

4. Acceptable Use and Restrictions

You are solely responsible for all content you create, upload, publish, send, receive, or store through the Services. You agree not to use the Services to:

• Generate outputs that violate intellectual property rights, contractual restrictions, or applicable laws.
• Publish photographs of others or make such photographs available in a manner that allows identification without authorization.
• Impersonate any other individual or entity, including employees or representatives of Musein AI.
• Generate content that is unlawful, defamatory, harassing, sexually explicit, highly deceptive (including malicious deepfakes), or otherwise harmful.
• Scrape, reverse-engineer, or systematically extract data from the Services to train, develop, or fine-tune any competing artificial intelligence models.

5. Generative AI Specific Disclaimers

You acknowledge that Musein AI utilizes experimental and rapidly evolving generative AI technology.

• Unpredictability: AI behavior can be unpredictable. We do not guarantee that the Outputs will always be accurate, complete, reliable, or free from bias or “hallucinations”.
• Use at Your Own Risk: You understand and agree that access to and use of the Services is at your own risk. You should not use AI-generated content for critical decisions without independent human verification.
• Content Exposure: You understand and agree that you may be exposed to content that is offensive, unlawful, misleading, or otherwise inappropriate, and Musein AI shall bear no responsibility for such content.

6. Third-Party Services

The Services may display, include, or provide third-party content, data, applications, or materials (“Third-Party Materials”), or provide links to third-party websites and AI models. By using such tools, you agree that Musein AI may transmit relevant information to designated third parties, and how such third parties use your information is governed by their respective policies and is beyond our control.

7. Copyright Infringement (DMCA Policy)

If you believe that any material on the Services infringes upon your copyright, please submit a formal takedown notice to our designated Copyright Agent at legal@musein.ai. Your notice must include:

• Identification of the copyrighted work claimed to have been infringed;
• Identification of the allegedly infringing material and its location within the Services;
• Information sufficient to contact you (address, telephone number, email);
• A statement that you have a good-faith belief that the use is unauthorized;
• A statement under penalty of perjury that the information provided is accurate and you are authorized to act on behalf of the owner.

8. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSEIN AI AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

In no event shall Musein AI be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your access to or use of (or inability to use) the Services or AI Outputs.

9. Governing Law and Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by the courts of Singapore.

10. Modifications to the Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide reasonable advance notice via the musein.ai website or by email prior to any new terms taking effect. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised Terms.
